okay so i am so mad i could kill. i am in a hotel by myself and im here in a city i dont know well without a car. so my only option for lunch was to ride a bus or get delivery and i'm not comftorble with the bus system here. Okay so I went online and found a good looking chinese restaurant and ordered. my order was like 7 dollars and then the 4 dollar delivery charge.
well then it got here and i went down to the hotel lobby to pick it up. the delivery guy said "that'll be thirty dollars." i said no, my order was only 7 dollars. he said my order was only 7 dollars but there is a 30 dollar minimum! he showed it to me on the menu and i said well that is NOT on the online version of the menu.
and so we fought and yelled and he said that if I didnt pay the thirty dollars he would call the police and the people in the hotel lobby said they would call security to remove me from the hotel. i ended up getting out the money and i threw it in his face and didn't tip because i was so mad. then i threw down the food onto the floor in front of him.
anyway i am PISSED, is there a way i can sue the restaurant or the hotel even? they made an idiot out of me in public and i am willing to take this to the courts. i was ROBBED of at least 20 dollars.I am madder then i have EVER been, can i sue the restaurant... so mad i am CRYING?
After the age of 5 or so temper tantrums are really socially unacceptable. Your choices were to not pay and refuse the food, pay and then call the restaurant after doublechecking that you just didn't miss the place where it told you of the $30 minimum charge in a respectful tone of voice (probably won't get your money back, but they may correct the website for future people), or refuse and call the better business bureau and complain. Throwing the food in his face was actually assault and he could have pressed charges against you.
All you had to do was refuse the order, they can't make you pay for it, or eat it.
Sueing will cost you thousands of dollars...is it worth it to recoop $20? I would say you made a fool of yourself on this one. Next time just walk away...the guy can't make you pay him.I am madder then i have EVER been, can i sue the restaurant... so mad i am CRYING?
That's messed up, they should have told you on the phone about that policy. As far as whether or not you can sue find a law firm with a free consultation, sounds to me like its worth pursing but I'm just a regular guy not a legal professional.
The police would not get involved if he called them, that would be a civil dispute between you and the restaurant. Also, the hotel would have no business kicking you out either.
Now, I'm sure you were probably acting irate to this delivery man, and that is something that could cause the hotel to kick you out.
You should have just refused to pay him anything more than the 11 dollars that your order and the delivery charge was, let him call the police and waste his time on the clock. The police would not do anything again as it is a civil dispute, as well as the website (or phone) should not be accepting of a delivery under the minimum.I am madder then i have EVER been, can i sue the restaurant... so mad i am CRYING?
You made an idiot out of yourself. Don't you think it's childish to talk about suing a hotel that did nothing but allow you to rent a room? It will cost you a lot more to file the lawsuit than the measly $20 you lost. You have just learned a valuable lesson.
Make a complaint about the restaurant with the better business bureau. But next time someone tries to trick you into some food delivery thing, just refuse the food. They can't make you pay. Courts, police and things like that have better things to do than solve a 20 dispute

All you had to do was refuse the order. They can't make you pay. The police won't come to resolve a lousy $30 food delivery issue.
